By accessing or using Canoptics services, you agree to be bound by these Terms of Service and our Privacy Policy. If you do not agree to these terms, do not use our services.
Canoptics provides a vegetation intelligence platform that uses satellite imagery, LiDAR, and machine learning to predict vegetation risk for critical infrastructure. Our services include data analysis, risk scoring, reporting, and API access.
To access certain features, you must register for an account. You agree to provide accurate information and keep it updated. You are responsible for maintaining the confidentiality of your account credentials and for all activities under your account.

You retain all rights to data you upload to our platform ("Customer Data"). By using our services, you grant us a limited license to process your Customer Data solely to provide the services. We do not claim ownership of your Customer Data.
Canoptics and its licensors own all intellectual property rights in the services, including software, algorithms, models, and documentation. These Terms do not grant you any rights to use Canoptics trademarks or branding.
Fees for our services are set forth in your subscription agreement. All fees are non-refundable unless otherwise specified. We may change our fees with 30 days' notice.
We strive to maintain high availability but do not guarantee uninterrupted service. We may modify, suspend, or discontinue services with reasonable notice. Specific uptime commitments are detailed in your service level agreement.
Our services are provided "as is" without warranties of any kind. We do not warrant that our services will be error-free, secure, or meet your specific requirements. Our risk assessments are predictions based on available data and should not be the sole basis for operational decisions.
To the maximum extent permitted by law, Canoptics shall not be liable for any indirect, incidental, special, consequential, or punitive damages. Our total liability shall not exceed the fees paid by you in the twelve months preceding the claim.
You agree to indemnify and hold Canoptics harmless from any claims arising from your use of our services, your violation of these Terms, or your violation of any rights of a third party.
Either party may terminate the subscription as specified in your agreement. Upon termination, your access to the services will cease, and we will delete your Customer Data within 90 days unless legally required to retain it.
These Terms are governed by the laws of the State of California, without regard to conflict of law principles. Any disputes shall be resolved in the courts located in San Francisco, California.
We may update these Terms from time to time. We will notify you of material changes via email or through our services. Continued use after changes constitutes acceptance of the updated Terms.
