1. Agreement to Terms

By accessing or using the services provided by Attest, Inc. ("Attest," "we," "us," or "our"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, you may not access or use our services.

2. Description of Services

Attest provides AI agent validation and oversight infrastructure, including validation engines, human-in-the-loop review systems, policy management, and audit logging ("Services"). Our Services help organizations deploy AI agents safely and compliantly.

3. Account Registration

To use our Services, you must create an account. You agree to provide accurate information and keep it updated. You are responsible for maintaining the security of your account credentials and for all activities that occur under your account.

4. Acceptable Use

You agree not to:

  • Use our Services for any unlawful purpose
  • Attempt to gain unauthorized access to our systems
  • Interfere with or disrupt our Services
  • Reverse engineer or attempt to extract source code
  • Use our Services to validate actions that are illegal or harmful
  • Exceed rate limits or abuse our API
  • Resell or redistribute our Services without authorization

5. Customer Data

You retain ownership of all data you submit to our Services ("Customer Data"). You grant us a limited license to process Customer Data solely to provide our Services. We will handle Customer Data in accordance with our Privacy Policy and any applicable data processing agreement.

6. Fees and Payment

Certain features of our Services require payment. You agree to pay all applicable fees as described on our pricing page. Fees are non-refundable except as required by law. We may change our fees upon 30 days' notice.

7. Service Level Agreement

For paid plans, we commit to 99.9% uptime for our API services. If we fail to meet this commitment, you may be eligible for service credits as described in our SLA documentation. Enterprise customers may negotiate custom SLAs.

8. Intellectual Property

Our Services, including all software, documentation, and content, are protected by intellectual property laws. We grant you a limited, non-exclusive license to use our Services in accordance with these Terms. You may not copy, modify, or create derivative works without our permission.

9. Confidentiality

Each party agrees to keep confidential information received from the other party confidential and not to disclose it to third parties, except as necessary to perform obligations under these Terms or as required by law.

10. Warranties and Disclaimers

We provide our Services "as is" and "as available." We make no warranties, express or implied, regarding our Services, including warranties of merchantability, fitness for a particular purpose, or non-infringement. We do not warrant that our Services will be uninterrupted or error-free.

11. Limitation of Liability

To the maximum extent permitted by law, Attest shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits or revenues. Our total liability under these Terms shall not exceed the fees you paid to us in the 12 months preceding the claim.

12. Indemnification

You agree to indemnify and hold harmless Attest and its officers, directors, employees, and agents from any claims, damages, or expenses arising from your use of our Services or violation of these Terms.

13. Term and Termination

These Terms remain in effect until terminated. You may terminate by closing your account. We may terminate or suspend your access for violation of these Terms or for any reason with 30 days' notice. Upon termination, your right to use our Services ceases, and we may delete your data after a reasonable retention period.

14. Changes to Terms

We may modify these Terms at any time. We will notify you of material changes via email or through our Services. Continued use of our Services after changes take effect constitutes acceptance of the modified Terms.

15. Governing Law

These Terms are governed by the laws of the State of California, without regard to conflict of law principles. Any disputes shall be resolved in the state or federal courts located in San Francisco County, California.

16. General Provisions

These Terms constitute the entire agreement between you and Attest regarding our Services. If any provision is found unenforceable, the remaining provisions will continue in effect. Our failure to enforce any right does not waive that right.
